Notification of claim:
The claim must be notified in the bankrupt estate on the website www.onlinekonkurs.dk within four weeks after the pronouncement of the bankruptcy order. Documentation in the form of account statements, invoices, judgment, settlement, etc. must be uploaded. The claim must be calculated with interest as per the date of order.
Privileged / secured claims:
If you are of the opinion that your claim is entitled to preferential treatment (has priority) or is secured by a mortgage or pledge, guarantee, retention of title, etc., this must be specifically stated and verified in connection with the notification of your claim.
Examination of claims:
When it has been clarified whether or not there will be any dividend payments to the claims filed in the respective claim categories, the trustee will examine the claims and recommend that the claims are approved or rejected in connection with the examination of claims.
The trustee will announce the examination of claims in the Danish Official Gazette and will also inform the creditors directly in writing. Only if you receive a letter from the trustee stating that your claim is not approved, you are to appear at the examination of claims. If you do not hear from the trustee, you may consider your claim to be approved as filed.
Information from the trustee:
At first, the trustee will inform all known creditors about the bankruptcy in a so-called Circular Letter pursuant to Section 124 of the Danish Bankruptcy Act, which is the first circular letter regarding the bankrupt estate.
Within three weeks after the pronouncement of the bankruptcy order, the trustee will forward a statement outlining the assets and liabilities of the bankrupt estate, cf. Section 125, subsection 1, of the Danish Bankruptcy Act.
Within four months after the pronouncement of the bankruptcy order, the trustee will forward a new statement outlining the main reasons for the bankruptcy and specifying the most important accounting figures, cf. Section 125, subsection 2, of the Danish Bankruptcy Act.
Within 10 months after the pronouncement of the bankruptcy order, the trustee will forward a status report, cf. Section 125, subsection 4, of the Danish Bankruptcy Act – and after this, a status report will be forwarded every six months.
As soon as the trustee knows for certain that there will be no dividend to the creditors, the trustee will inform the creditors of this, so that they may write off the debts as a loss.
